U.S. reform process for screening foreign investment

Foreign direct investment in the United States is reviewed by the Committee on Foreign Investment in the United States (CFIUS) for its compatibility with national security. The U.S. Treasury Department aims to simplify and expedite this review process. This reform is part of the White House's "America First Investment Policy," adopted last year, which seeks to increase private investment in the United States.

Faster Review Through the "Known Investor Program"

The centerpiece of the CFIUS reform is the "Known Investor Program". This program allows companies to submit information about themselves before an investment in the U.S. is planned and subject to review. Participation in this program cannot replace investment screening; rather, it is intended to enable reviewing agencies to determine early on whether an investing company poses a risk to national security. To this end, CFIUS intends to request and review information about the company's structure, owners, management, and business activities at an early stage. Companies accepted as "known investors" are expected to benefit from faster review of their investment plans in the U.S. later on. The "Known Investor Program" is currently under development.

Interested stakeholders can comment on the reform until March 18. The U.S. Department of the Treasury has published a request for information for this purpose . Comments on the investment review and suggestions for its simplification may also be submitted. All comments will be published.
